However, there are several shortcomings with this charter in regards to situations that are out of the airline&#8217;s control.<\/p>\n\n\n\n<p>For example, the labour shortage is a carrier-driven situation. However, if the underlying cause is a COVID-19 outbreak among the crew, would the lack of personnel then be considered a circumstance out of control?<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1600\" height=\"901\" src=\"https:\/\/mp-2702.milesopedia.dev\/wp-content\/uploads\/2021\/06\/unnamed-file.png\" alt=\"Changes to the Air Passenger Protection Regulations (APPR) - Covid-19 D\u00e9pistage\" class=\"wp-image-148916\" srcset=\"https:\/\/mp-2702.milesopedia.dev\/wp-content\/uploads\/2021\/06\/unnamed-file.png 1600w, https:\/\/mp-2702.milesopedia.dev\/wp-content\/uploads\/2021\/06\/unnamed-file-450x254.png 450w, https:\/\/mp-2702.milesopedia.dev\/wp-content\/uploads\/2021\/06\/unnamed-file-1024x577.png 1024w, https:\/\/mp-2702.milesopedia.dev\/wp-content\/uploads\/2021\/06\/unnamed-file-200x113.png 200w, https:\/\/mp-2702.milesopedia.dev\/wp-content\/uploads\/2021\/06\/unnamed-file-768x433.png 768w\" sizes=\"(max-width: 1600px) 100vw, 1600px\" \/><\/figure>\n\n\n\n<p>As a result, the <a target=\"_blank\" href=\"https:\/\/otc-cta.gc.ca\/fra\">Canadian Transportation Agency<\/a> has just announced changes to better protect passengers in the event of a flight delay or cancellation beyond the control of the carrier.<\/p>\n\n\n\n<p>These <a target=\"_blank\" href=\"https:\/\/otc-cta.gc.ca\/fra\/apercu-reglement-modifiant-reglement-sur-protection-des-passagers-aeriens\">changes<\/a> took effect on September 8, 2022.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-review-of-the-air-passenger-protection-regulations\">Review of the Air Passenger Protection Regulations<\/h2>\n\n\n\n\n\n<p>The <strong>Air Passenger Protection Regulations<\/strong> are a passenger bill of rights that dictate the minimum obligations that airlines must fulfill to the travelling public.<\/p>\n\n\n\n<p>All airlines operating flights to and from Canada must comply.<\/p>\n\n\n<aside class=\"component component__notice component__notice--info wp-block-milesgutenberg-notice\">\n\t\t\t\t<i class=\"fas fa-info-circle\"><\/i>\n\t\t<div class=\"component__notice__content\">\n\t\t\t\t\n\n<p>This article discusses the <strong>Air Passenger Protection Regulations<\/strong> and the compensation you may receive following a flight delay or cancellation. This rule applies to youth under the age of 14. During the current pandemic period, <a href=\"https:\/\/mp-2702.milesopedia.dev\/en\/guide\/tutorials\/change-time-flight-rights-compensation\/\">schedule changes<\/a>, as well as delayed and cancelled flights, have become commonplace.<\/p>\n\n\n\n<p>Since the beginning of the RPPA, airlines are required to pay you monetary compensation if they were responsible for the late arrival at your destination.<\/p>\n\n\n\n<p>The situations attributable to the airline are:<\/p>\n\n\n\n<div class=\"component component__list\"><ul class=\"wp-block-list\">\n<li>commercial overbooking<\/li>\n\n\n\n<li>mandatory routine maintenance of the aircraft<\/li>\n\n\n\n<li>mechanical failures found during routine maintenance<\/li>\n\n\n\n<li>delay or cancellation of a flight due to lack of crew<\/li>\n\n\n\n<li>communication of flight change or cancellation within 14 days of departure<\/li>\n<\/ul><\/div>\n\n\n\n<p>In these situations, the carrier&#8217;s responsibilities are:<\/p>\n\n\n\n<div class=\"component component__list\"><ul class=\"wp-block-list\">\n<li>offer meals or meal coupons<\/li>\n\n\n\n<li>provide accommodation and return transportation if the delay is overnight<\/li>\n\n\n\n<li>offer an alternative route (including another airline) to the destination if the delay is more than 9 hours<\/li>\n\n\n\n<li>offer the possibility of a refund<\/li>\n<\/ul><\/div>\n\n\n\n<p>Compensation varies according to the time incurred if the company is responsible:<\/p>\n\n\n\n<div class=\"component component__table\"><figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><td>Delay<\/td><td>Large companies<\/td><td>Small companies<\/td><\/tr><\/thead><tbody><tr><td>between 3 and 6 hours<\/td><td>$400<\/td><td>$125<\/td><\/tr><tr><td>between 6 and 9 hours<\/td><td>$700<\/td><td>$250<\/td><\/tr><tr><td>9 hours and more<\/td><td>$1,000<\/td><td>$500<\/td><\/tr><\/tbody><\/table><\/figure><\/div>\n\n\n<aside class=\"component component__deferred_contents wp-block-milesgutenberg-deferred-contents\">\n\t\t\t\t<div\n\t\t\t\tdata-template='s-h'\n\t\t\t\tdata-post_type='post'\n\t\t\t\tdata-per_page='4'\n\t\t\t\tclass='deferred_container--preload container_post container_template--s-h container_count--1'\n\n\t\t\t\t\t\t\t\t\tdata-tag=\"post_id\"\n\t\t\t\t\t\t\tdata-post_ids=\"74980\"\n\t\t\t\t\t\t\t>\n\t\t<article class=\"post-preview\">\n\t<div class=\"post-preview-thumbnail\">\n\t\t<div class=\"shimmer shimmer-image\"><\/div>\n\t<\/div>\n\t<div class=\"post-preview-content\">\n\t\t<div class=\"simmer-bar-group\">\n\t\t\t<div class=\"shimmer shimmer-bar\"><\/div>\n\t\t\t<div class=\"shimmer shimmer-bar\"><\/div>\n\t\t<\/div>\n\t<\/div>\n<\/article>\t\t<\/div>\n\n\t\t<\/aside>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/mp-2702.milesopedia.dev\/wp-content\/uploads\/2022\/06\/Retard-orages.jpg\" alt=\"Changes to the Air Passenger Protection Regulations (APPR) - Retard orages\" class=\"wp-image-215358\"\/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-changes-to-the-air-passengers-protection-regulations-september-2022\">Changes to the Air Passengers Protection Regulations (September 2022)<\/h2>\n\n\n\n<p>As of September 8, 2022, passengers are also protected against situations categorized as &#8220;out of control&#8221; by the carrier, such as weather delays, strikes, COVID-19, etc.<\/p>\n\n\n\n<p>The RPPA rules regarding delays due to company circumstances remain unchanged.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-48-hour-window\">The 48-hour window<\/h3>\n\n\n\n<p>In the event of a delay of more than 3 hours, the <strong>Air Passenger Protection Regulations<\/strong> require the carrier to rebook you on another confirmed flight according to your preferences. The latter (their aircraft or another airline) must be within 48 hours of the departure time of your initial flight.<\/p>\n\n\n\n<p>If the airline is unable to rebook you on another flight within the 48-hour window, you will have the option of receiving a refund or booking a later flight.<\/p>\n\n\n\n<p>However, there will be no compensation if the cause of the delay is beyond their control.<\/p>\n\n\n\n<p>Finally, if you request a refund, it must be given to you within 30 days.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-method-of-reimbursement\">The method of reimbursement<\/h3>\n\n\n\n<p>Effective September 8, 2022, if the carrier cannot issue you a new confirmed ticket within 48 hours of your original departure, you may request a refund.<\/p>\n\n\n\n<p>A refund of the unused portion of the ticket must be made in the original form of payment for flight delays and cancellations for reasons beyond the airline&#8217;s control. The carrier may also issue a travel credit if and only if it does not have an expiration date.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-changes-to-the-air-passengers-protection-regulations-september-2023\">Changes to the Air Passengers Protection Regulations (September 2023)<\/h2>\n\n\n\n<p>In a <a target=\"_blank\" href=\"https:\/\/www.canada.ca\/en\/transport-canada\/news\/2023\/04\/minister-of-transport-presents-proposed-amendments-to-the-canada-transportation-act-to-strengthen-air-passenger-rights-and-simplify-the-complaint-r.html\">press release<\/a>, the government has proposed certain changes to the APPR that could be in effect as of September 30, 2023.<\/p>\n\n\n\n<p>Basically, these changes are intended to close the various loopholes with the current rules so that passengers can be compensated more easily. Indeed, when the RPPA was introduced in 2019, airlines had to compensate their customers when a delay or cancellation occurred within their control such as a lack of crew for example.<\/p>\n\n\n\n<p>However, events beyond their control such as weather or security-related issues were not eligible for compensation. Therefore, these reasons were often cited as the cause of delays.<\/p>\n\n\n<aside class=\"component component__deferred_contents wp-block-milesgutenberg-deferred-contents\">\n\t\t\t\t<div\n\t\t\t\tdata-template='s-h'\n\t\t\t\tdata-post_type='post'\n\t\t\t\tdata-per_page='4'\n\t\t\t\tclass='deferred_container--preload container_post container_template--s-h container_count--1'\n\n\t\t\t\t\t\t\t\t\tdata-tag=\"post_id\"\n\t\t\t\t\t\t\tdata-post_ids=\"209982\"\n\t\t\t\t\t\t\t>\n\t\t<article class=\"post-preview\">\n\t<div class=\"post-preview-thumbnail\">\n\t\t<div class=\"shimmer shimmer-image\"><\/div>\n\t<\/div>\n\t<div class=\"post-preview-content\">\n\t\t<div class=\"simmer-bar-group\">\n\t\t\t<div class=\"shimmer shimmer-bar\"><\/div>\n\t\t\t<div class=\"shimmer shimmer-bar\"><\/div>\n\t\t<\/div>\n\t<\/div>\n<\/article>\t\t<\/div>\n\n\t\t<\/aside>\n\n\n\n<p>With the changes that came into effect in September 2022, the government has established measures that require airlines to rebook the passenger on another flight within a 48-hour window, as explained earlier in this article.<\/p>\n\n\n\n<p>For 2023, the federal government aims to place the burden of proof on the airline to avoid the need for customers to demonstrate that the reason for the delay was actually within their control. This is indeed a problem right now, as we often see people getting different explanations about their travel blunders when they were all on the same flight!<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-travel-insurance\">Travel insurance<\/h2>\n\n\n\n<p><a href=\"https:\/\/mp-2702.milesopedia.dev\/en\/personal-finance\/insurance\/save-travel-insurance\/\">Travel insurance<\/a> should not be overlooked even though the RPPA protects against flight delays and cancellations. For example, a flight delay could result in <a target=\"_blank\" href=\"\/?p=232925\">the loss or late arrival of your luggage<\/a>!<\/p>\n\n\n\n<p>The <strong>Air Passenger Protection Regulations<\/strong> assure that the carrier must book you on another flight within 48 hours. However, if your bags get lost in the airport rush, <a href=\"https:\/\/mp-2702.milesopedia.dev\/en\/personal-finance\/insurance\/travel-insurance-credit-cards\/\">good insurance<\/a> will reimburse you to replace your belongings.
